Cops fabricating evidence

The other day i went to the video store, got some vids, jumped in my car and proceded to drive home. I looked across the road and saw some coppers. I was driving happily home when i saw the lights flashing, wasn't really worried, i hadn't done anything wrong. The cop came over and i opened my door (my window doesn't work) so i could talk to him. He started yelling at me "STAY IN THE VEHICLE SIR, DO NOT GET OUT OF THE VEHICLE!". I told him that my window was broken and started to open the door, he started yelling at me to open the window??? Anyway after i had worked out with him that my window is broken and that i had to open the door to talk to him he started questioning me.

PIG "I want to ask you a few questions sir. I want to know why when you saw us that you did a u-turn, pulled over to the side of the road and when you thought we were gone you burned off?"

Innocent civilian. "What are you talking about?, I just got some videos and got in my car and started driving home"

PIG "Don't lie to me sir. I saw you do a u-turn, pull over to the side of the road and then burn off when we were gone. I'm trying to find out why you are acting so suspiciously. Why are you acting so suspiciously sir?"

Innocent civilian "I don't know what you are talking about, i just got some videos and started driving home"

PIG "Please answer the question sir. Why are you acting so suspiciously?"

Innocent civilian "Man i don't know what you are talking about. I've done nothing wrong"

PIG "please answer the question sir"

Innocent Civilian "I am acting suspiciously because i got a video and started driving home? What are you talking about?"

PIG "So you admit that you were acting suspiciously"

Innocent civilian "NO. What the fuck is going on man? I just went to the fucking store, got some fucking videos and started driving home. Here are the fucking videos so what the fuck is going on?"

PIG "Do you realise it is an offence to swear at a police officer sir?"

Innocent civilian "No, man i just wat to know what is going on. I've done nothing wrong, you keep saying things that i haven't even done i just want to know what i've done"

PIG "have you been drinking this evening sir?"

Innocent civilian "I had a beer about half an hour ago"

PIG "so you admit that you are driving under the influence?"

Innocent civilian "No, i didn't say that, i just had a beer half an hour ago. Breath test me if you want"

He breath tested me and it was sweet

PIG "This your car sir?"

Innocent civilian "Sort of mine"

PIG " Are you saying you are driving a car that doesn't belong to you sir?"

Innocent civilian "Sort of man"

PIG "so this is a stolen vehicle sir?"

Innocent civilian "I didn't say that, i just bought it but i haven't been to the registry cause i haven't had the money"

PIG "How do i know that sir? You could be lying to me, are you sure you have not stolen this car sir. It would explain why you are acting so suspiciously sir"

Innocent civilian "here are the fucking rego papers, i just haven't taken them in yet, there's his signature, its my car"

PIG "this bottom slip needs to be taken to the registry by the owner, why do you have it sir"

Innocent civilian "Cause they were going to peru after i bought it, they didn't have time, i said i'll take it in"

PIG "That is not the correct procedure sir"

then he went back to his car, turns out that the car ISN"T registered because of the person that had it didn't pay their fines. (as soon as i take it in it will be sweet tho)

He kept asking where i was living, now i know this is not right but i told him a previous address. I did this because i felt genuinely imtimidated by this deadshit, i actually thought he was going to bash me when he was talking to me.

The wanker came back and told me i couldn't drive anywhere unless it was to register my car. I asked if i should drive to a friends place so that they could take me places thhis long weekend and he told me that because he was wearing a microphone if he suggested i dp anything it would be his arse on the line. He left me on a blind corner on the highway, then the bastard drove off but i saw him pull off the highway about 200m behind me, the bastard was waiting for me to drive off!!!

Anyway when i went home, had to wait ages before the cops pissed off, i thought about what was going on. Because gthe whole conversation was being recorded he could faricate any evidence he wanted to. Thats why he was saying that i had done a u-turn and burned off!!! Man day by day i feel like our police force is becoming way too powerful. I mean the offence he fabricated for me was quite small but imagine what they can do. I have no idea why this cop woud do this to me but my heart jumps now when i see a cop car, and that did not happen before this incident. I'm still pretty shaken by this.

Here are 2 examples of what they can do now.

Asshole. little more to say, they aren't all like that, but the ones who think they are the shit just because they have a badge should be...well shouldn't say anything or one might accuse me of plotting to murder an officer lol. You just know he was bullied as he grew up and now he's taking it out on everyone he can...jerk. Sorry to hear it man.

Also remember that they have quotas they have to fulfil... a certain number of crimes or "bad guys" busted in a certain time period!

Once a friend was driving his girlfriends unregistered car and the cops came over in the service station and starting hassling him and eventually booked him for driving the unregistered car. He is not the kind of person who swears at all... but in the police report the cop put in about the incident, out of every 3 words, two were expletives that my friend allegedly spoke to the cop!

I guess after a while they just learn to see how "the system" works, i.e. "truth is out of style", and so that becomes the norm for them.

After talking to a few people about this incident i have found out that the 'littleman with power' cop is known as an absolute fucking bastard around town. For those in byron it is the guy who drives the orange patrol car usually. One friend of mine who's mother is very ill and has to work at the iga packing shelves to help with the groceries and go still to school (I'm not making this up hey, even though it is so cliche) was finishing a shift and was riding home on his bike without a helmet or a light on his bike. The lowlife copper booked him for both and asked his address whilst questioning the poor kid. The kid walked his bike a little while and then decided to ride home when he deemed it 'safe'. The copper was waiting for him near his house and then booked him again! It was $90 each time. And this is even after the kid explained that he didn't have enough money for a helmet because he had to support his mum and brother!!!

Another friend of mine was getting pulled over by him every time he saw her car and then would let her off and started hitting on her! After it happened a handful of times she felt she was being harrassed so she made a complaint but nothing happened. The next time the copper saw her he put on his lights and then whizzed passed her nearly hitting her car and causing her to drive off the HIGHWAY, her kid was in the back as well. Then he turned around, pulled her over again and started to tell her that he was going to book her for reckless driving!!! This dickhead is really something else hey. He does nothing but damage police public relations.

Does anyone know if it possible to get tapes when they have recorded you? I want to get a copy of the recording of me talking to this deadshit. Then i'm going to go to the video store and get the reciept for me hiring some dvds which will show the time of hiring. i was actually in there for about 30 minutes because the guy at the shop is a mate, there is NO way that this cop did not see me get out of that shop. And he certainly didn't see me do a u-turn, pull over to the side of the road and burn off. Getting the time that i hired the tapes and comparing them with the time that he pulled me over will prove that this guy has made up a whole heap of bullshit and will hopefully be suspended for a while or something, people like this should not be given free range to do whatever the fuck they like. he is nothing but a pathetic little man.

People like this are jerks, good luck bringing down some justice on him but I don't like your chances of it, however maybe if he has had some complaints against him already the force might be more willing to hear your story.

I would LOVE to bring this guy to justice. I don't think it would be that hard, just get the tape of him lying and then compare it with the time that i rented the dvds, he's obviously lying, surely that would be illegal, i mean everything else is.

I just went out to go take a piss (i'm in town on a public computer) and i saw THE SAME GUY booking a lady for failing to indicate whilst turning. She was in the car park, I saw the whole thing and watched him give her a ticket for that and failing to have her license. They must be pretty short of their bad guy quota this month, or maybe he wants some time off. This guy needs to be stopped.

You should be able to get the tape (as it has your voice on it) through FOIA request. Might take a long time. Register a complaint with NSW Police Integrity Commission. Register a complaint with the commanding officer of your local command (or the highest ranking person who will listen). HIRE A LAWYER. Try and track down as many people who are victims of his harassment as possible, and band them together.

Keep in mind doing these things will probably make you a very large target for vindictive behaviour by the local police force.

If you know who he is you can make a complaint. It won't actually do anything at the moment. But after a while, if he has lots of complaints it will start to look bad on his record and he will find it hard to get jobs. A bit like Karma.

Write down everything that happened - dates, times etc etc. Make it clear that he must have been mistaken and he made you feel very uncomfortable and basically tell your story and let them know how he made you feel. There are lots of jerk police around but the good thing is official complaints stick. If you have done nothing wrong you have nothing to worry about.

Try not to get too shaken by this - he was in the wrong... everyone knows about these kind of young police - nobody likes them (including senior police) it makes them look bad.

I also had questions as to the legality of you being recorded without being informed. Found this:

Currently there is no prohibition on the recording of video images in NSW. However, recording conversations by means of a listening device is an offence under the Listening Devices Act 1984 unless both parties consent.

The bill therefore creates an exemption from the Listening Devices Act to enable police to use ICV to audio-record interactions with members of the public regardless of whether consent is given.

I would now like to describe the technical aspects of the ICV system. The system consists of two video cameras, a recorder, a monitor, a wireless microphone and control mechanisms to allow an audio and video recording to be made.

One camera is able to point forward, the other backwards. The monitor and control centre are mounted within easy reach of the driver's seat. A wireless microphone is worn on the lapel of an officer to allow the audio recording of events outside the car.

The ICV system commences recording automatically when the primary lights are turned on, the alert button is pressed or the radar is locked on. Additionally, the ICV system can be manually activated via the master switch or the remote microphone.

Approximately 350 highway patrol vehicles will be fitted with ICV with the rollout to be completed by mid 2005. ICV is not only limited to highway patrol officers but will extend to any police officer using a vehicle fitted with ICV.

Hehehe makes me think of a story a friend told me. He was on his way to work one morning when an officer pulled him up to test him for using MJ, amph etc. He was confused and a bit amused since it was like, 8.30 in the morning. The coppa asked him if he had been using drugs, and then told him that they had ways to listen to what they were saying inside the car :S Not sure if my friend had this confused with being told he was being recorded but from what he told me it sounded like the cop was saying that from outside the car, they could hear inside peoples car :S. if that is what he was saying then he must've been the one on the drugs, fairly stupid intimidation technique, suppose just on the off chance that my mate had been talking about using drugs before being pulled up lol, never know, maybe one day he'll get lucky. Some of their intimidation techniques are just funny though, we were on our way out to a doof and got pulled up, the cop goes to the driver 'have you been drinking', he goes 'no' (which he hadn't been, he was stone sober)and the officer says 'yes you have'...wonder if he expected my friend to just break down and spill his guts that he was drunk (which he wasn't)...idiots, some of them anyway.

If you can file official complaints against a Bad cop and have it stick can you file official compliments on Good cops?

Its no wonder cops act like they have a flea bite on a rash on a hemorrhoid if they or their buddies are only complained against. Cops need to somehow be rewarded when they arent assholes. Like giving a cookie to a kid who decided to clean his room rather than pour paint in his sisters hair.

I'm not sure if there is an official good cop 'gold star' but it can't hurt. I think it would be a nice thing to do and would encourage good behavour. I've heard of people getting stopped by the police for good driving (i'm pretty sure I have...) they were rewarded with a free cap and drink bottle.

There was a guy who was so fed up with getting grief from the fuzz that he set up a cam corder in his car to record general events.

When he was pulled over for no particular reason the police asked him where he was going, he replied that that was his business and didn't want to discuss his personal life with the police man. The cop went berserk with verbal abuse and threats of physical violence and jail.

Video ended up on u tube the next day and the cop got reamed for it.

The only way to prevent or proove anything is to set up your own recording device in your vehicle.

I don't think i'm going to anything about this, nothing will come of it but trouble. I WAS driving an unregistered car, even if i didn't know i was, and i did swear at this wanker quite a bit so i'd prolly get a fine for both and then be victimised forever after. One thing that i have thought of is if that chick that i revesred into decides to do anything about the incident (in carpark scammer post) then i will be screwed cause the car wasn't registered!!! I haven't heard anything from her and i'm praying i won't.

ive seen police enter private property (without a warrent or invitation from property owner) and record voice and video media, as well as photographing number plates of cars on this private property.

i think most cops dont even know what they can or cant do...

i walked up to them and informed them they were not allowed to enter the property without a warrent or permission/invitation from the property owner, and that filming and recording individuals during their presence was illegal. (the senior sargent told me that what i was saying was a load of shit and they could do what they wanted)

They didnt react to my statements until i said i was calling the ombudsman, upon which they huddled together and then left the property. (only to sit 500m away from the property and pull over evry car that drove past)

in Hindsight i should have just let them do what they were doing cause the people they were targeting turned out to be absolute fuckwits who deserve everything the law can throw at them, but i was simply acting on what i knew to be the rights of the property owner, and the breaches the police had made to the very law they were supposedly trying to enforce. (and putting myself on the line in doing so)

most of my interactions with police have been great, if u tlk to them in the right way and behave in a friendly manner and just let them do their job they seem to be quite civil, of course there is the odd exception such as the officer in mention in this thread, however if u give them even the slightest attitude they all seem to have quite a short temper.

I remember an experience with some byron cops after a friend of mine was assaulted on the beach one night... We went to the station, told them where the guy was, what he had done, and they wouldnt have a barr of it unless the girl in question (who was quite distraught) came into the station and gave an official statement.

By the time she was calm enough to make a statement the dude had skipped town, and when three police officers wandered into the backpackers where he was staying, 24hrs after we originally informed them of the attack, i gave them some lip and all three of them pushed me against a wall and surrounded me and said "do u want to make something of it?"

Mostly they seem under trained, under staffed, over worked, and at times on a massive power trip.... however ive been in a few situations where they have been kind and lenient.. just like any other group of humans, it comes down to the individual, how you respond to them, and chance/luck.

I agree man, most of the time they are fairly good, some have no idea what they are allowed to do though, after a party one night a few years ago I had friends come up to stay at my house just near the party. This cop came up and started having words to me, I was perfectly civil, didn't swear and gave him respect, until he started to just walk into my carport, I told him I was pretty sure he wasn't allowed to do that, he gave me some lip about being a smart ass but amazingly enough, he returned to the road quick smart.

Its the ones that are jerks to everyone that lose the whole force respect, kids start to think that all cops are out to be power freaks on them and so the kids treat them with no respect, the cops who are civil and reasonable, i.e if you are drinking in a park at night with a few mates or have some music set up on the beach but no one is being disturbed, the ones that will just talk to you, lay out some ground rules like, don't get too loud and don't disturb the residents, but leave and don't threaten you or anything, they are the ones who get the respect, well from what i've seen anyway, because they leave and no one goes 'fucking cops, assholes', but rather 'thats cool'. And so they don't get treated like assholes.

Another example of a cop having no idea of what hes allowed to do is when there was a beach party on near where I lived and this cop who was yelling at kids to go home pulled his gun out and started waving it around, that was way out of line and from what I know, way illegal.

Pity to hear about your story _e, nothing worse than having the guys who are supposed to protect you turn on you probably angry because they realise that they didn't do their job.

Higho, reviving this old thread to avoid starting a new one. It is sorta related. I was with my boss and he got pulled over. This was in QLD where i was holidaying/working. THe coppa, a lady and being a right bitch, didn't tell us she was recording, i piped up and asked if they had to tell us and she said no because it was QLD, is that right? After putting lots of words into my boss' mouth and twisting lots of sentences he got fed up and said 'jeez i might as well have got a drug charge' (talking about her ridiculous treatment of him over just using a mobile phone). She says 'sir, are you admitting to me that you are a drug user?' I mean come on, what the fuck?! Power tripper, bullshit, thats my vent,

Why would you bother antagonising the officer like that? Did you expect a tipped cap and a have-a-nice-day after asking them whether they are recording the conversation? As for mentioning that you may as well have gotten a drug conviction, that is just some plain dumb shit to say to a cop? Of course they would question your latent self incrimination in such a scenario.

The only time another person has to get consent to record you is if they are NOT a cop.

Sorry to take us off on a bit of a tangent, but I'm not sure your statement is quite right.

Whilst I believe that to record a telephone conversation requires the express consent of the party being recorded - as is common practice in customer service - it is my understanding that an individual may record a face-to-face conversation that he or she is a party to without the consent or the knowledge of the other parties.
