SunChaser Posted May 1, 2005 Are they illegal we all know that Psilocybin is illegal. But Psilocybe cubensis is the only mushroom that's listed as being illegal and that's only in QLD, right. So if they wanted to charge you for possesing our growing a Psilocybe mushroom wouldent they have to prove you were going to use it for it's Psilocybin content witch they couldent unless they had caught you eating them or extracting them, someone must know what the deal is with this
Guest d0tb0y Posted May 1, 2005 There are legal parameters called 'intent'. Having a 'psychadelic mushroom growing guide' = intent to grow psychadelic mushrooms. Regardless of whether you actually do or not.
smogs Posted May 2, 2005 i thought because they had them chemical in them that made them illegal... and growing them with intent is manufacturing of said chemical. think about it... if u shoved a kilo of crack up a dogs arse... just because the dog isnt illegal doesnt mean u wont get in trouble
SunChaser Posted May 2, 2005 Firstly if you had selves of books on growing MJ and all the equipment to go with it, but no seeds plants or clones to go with it they can’t arrest you there for its not illegal, right! Secondly Peyote and San Pedro (for example) contain a controlled substance but it’s not illegal to grow them although it would probably be illegal to have them dry or processed in your procession so why wouldn’t Mushrooms be the same since Psilocybe’s are not on controlled substance list, in Victoria anyway. I’m no lawyer but there must be a loop hole to this law, I’ve done a lot of reading and no where did I find anything saying psychedelic mushrooms a illegal just Psilocybin  [ 02. 2b Posted May 3, 2005 quote: Firstly if you had selves of books on growing MJ Ahh yes but if like "Pihkal" the books have been refused classifacation , your guilty of another crime ?
apothecary Posted May 3, 2005 jabez, that's because it depends on the severity of the schedule. (afaik) You can be growing peyotl because it's on a different schedule from psilocybe. Some plants are illegal to posess in any form (e.g salvia) and some are only legal to posess as plants.
Fenris Posted May 3, 2005 Ahh yes but if like "Pihkal" the books have been refused classifacation , your guilty of another crime ? [/QB] Does that mean that by having Pihkal in my possession (theoretically) I have already committed a crime (theoretically)? Or is it all about intent? Benzito Posted May 3, 2005 Surely, just being born is a crime these days. By being born you are conspiring to do so many illegal things later in your life. If you had just stayed in the womb you never could rob a bank. So, you committed a crime by being born. Eventually they will try that one. But, not before we have thought police. 2b Posted May 3, 2005 quote: Does that mean that by having Pihkal in my possession (theoretically) I have already committed a crime (theoretically)? The way i read it , yep you've comitted a crime. i think it was Polyester in Melbourne that was raided for selling the book (not to be confused with Tihkal that ones ok ? ), there was a case of a guy in Perth from memory that had a heap of ' Rhodium' style files on his hard drive and was charged and fined a large amount of $ . I think in the black and white eyes of the sensors , books come in two catagories those that are compliant and those that aren't , if you search there site for what is not compliant (refused classification ) you'll see most of it is porn , and i suppose there is some porn that should be refused classification but in my eyes knowledge is power and no book deserves to be refused classification. Funny the site ' the hive ' was allowed to operate under an America system that allows freedom of speech (see the interview with strike that was posted a few weeks ago for the full story ) Kinda seems strange that Australia is so strict on this sort of legislation. smogs Posted May 3, 2005 in america the freedom of speach is in their constitution... it isnt here good and bad really... it stops alot of hate crimes and racism our way but also allows for government censorship what is the punishment for having a banned book anyways? I geuss that depends on the book and number etc but im sure it would be a fine and they take it off you.
2b Posted May 4, 2005 quote: what is the punishment for having a banned book anyways? Probably a fine and a blot on your record that would be enough to stop you getting a visa to travel to the US.
apothecary Posted May 4, 2005 People still go to the US? Mandatory fingerprinting, even for the "allies" like Australia? I got a better idea. Fuck the US.
2b Posted May 4, 2005 They now even want passanger lists for panes that pass through US airspace , so what even Hawaii ? I agree fuck them , it's getting to the point were you will need two passports to visist the US like Israel , one to go there on and another to use everywhere else so you don't get branded guilty by assosiation. smogs Posted May 4, 2005 umm dude Hawaii IS the US its one of its states...
Benzito Posted May 4, 2005 I think that's his point smogs. There is no whitehouse or anything else to blow up in Hawaii but they are still paranoid and treat it as if it was part of the mainland. There is no security risks in hawaii! Correct me if I missed your point 2b?
