Busted in Adelaide :(

Recommended Posts

The big day has come and gone, and I can now relax with some beers and bowls! My lawyer was giving me no confidence, so I sacked her and represented myself. The hearing went something like this:

...

The sherriff chased me out of the room, and said he couldn't beleive it! Nobody gets off free with hydro, and if I was caught again I would go to jail. With a grin like a cheshire cat, and my heartrate returning to normal, I said 'lucky me!', and went home to celebrate!

Thanks to everybody for your good wishes, support and advice.

Who would have thought standing up and acting like an adult would work better than a lawyer or self-represented impassioned speach about spiritual freedom to smoke weed or somesuch :P

Congrats, I think anyone who has been through the entire ordeal (from search warrant to court) deserves any breaks they can get!

If you have any lucky stars you forgot to thank, now might be the time

thanks meanies....nice bump! You can be sure...orrificer.....that I learned my lesson real good!

I am actually feeling heaps more relaxed not to have weed in my house 24/7. It used to piss me off heaps to not be able to bring home new friends from a party, because I was suspicious about smells leaking. My love life has improved no end from getting rid of those nasty weeds ;)

Yep, I wonder what it is about that plant that breeds such paranoia.

I know for certain that me, myself and I cannot go near it anymore... used to be a daily ab, user but haven't enjoyed the stuff for many years now. Just get too para... perhaps I really had learnt all I needed to from it.

But yeah... I would hate to face the situation you faced for any reason and man it's a bit inspirational to see you come through it and still participate in a forum such as this.

peace

It was no big deal really. I wasn't arrested or anything. Just a summons to court and plead my case.

Speaking of paranoia....I never used to worry about cops, I think a lot of the paranoia comes from a blood/sugar crash.

As far as I know, I am not diabetic, but in my experience, the white/green outs usually happened when I was dehydrated after sports. Thats why I think there is a blood/sugar effect

yeah right, interesting thought.

Only time I don't get para from mj is when I am sitting around a fire with mates after a surf... like when we are camping for a few days and have other stuff going on. There is no other time that I can smoke it and feel okay.

Even then it is only a very few tokes and that is all.

Used to chase the stuff like a fiend! Anyhow.

So you reckon that the para comes after you have used all the sugar etc in your system? Mine just comes any time I use it. I think that I am just not physiologically built for weed.

Same as some plants are more suited to some.

shrooms for one, cactus for another, dmt for yet another etc... we find our allies one way or another

peace

Thanks for all the good advice, I have decided that this is too important to risk defending myself. A good lawyer who specialises in drugs is the way to go.

They didn't even look at my computer. Also it was a detectives general search warrant that I let them in with. They said they had a tip off from crimestoppers, one of the cops said he could smell cannabis at the front door, therefore probable cause to produce search warrant. No point losing my herbs and paying to fix a kicked in door as well. I don't buy the crimestoppers story, but it is possible. I went to a hydro shop the same day, and I suspect the police had a lookout getting rego plates.

heat cameras mounted on choppers scan for irregualr ducting on houses, also anyone lax enough to use a card for purchases at a hydro store is vunerable, and or they record peoples liceance plates when visiting such a place.

That must feel sweet!

intelligence I think they call that.

Anyone else keeping up with internet reforms.

I believe the U.S is starting with the whole internet filtering thing... I'm sure you are aware of the guise they are using for it's implementation.

I don't know for sure dood, but I wasn't dealing, so my neighbors had no reason to be sus.

I put the bust down to a car rego plate being noted at a hydro shop.

Take notice anyone who goes to hydro shops, police may visit a few hours after.

Dont write off legal aid lawyers, somebody i know tried to represent themselves in a family court case and was simply sinking deeper and deeper, he finally got his act together and applied for legal aid. He was granted and got himself a what can best be described as a bulldog of a lawyer, he had been around for 25 years and was simply brilliant, he left no stone unturned, bullied his way in to every facet of the case and won a complete victory for the friend in what was a hopeless losing position only months earlier, this same lawyer turner barrister soon after and whilst all cannot be so lucky in who they may get to represent them, legal aid is brilliant as far as my friend and my opinion is concerned.

It's a tricky choice santiago, I guess it all comes down to confidence and vibe...in my situation, the day before my hearing, a $250 a day lawyer was telling me she would only ask for a 'no conviction' if the case in front of me went smoothe......And I am like.."you've got to be shitting me....what the fcuk am I paying you for?"...I sacked her and represented myself. In South Oz, it's not a big deal to grow cannabis, but the law doesnt like you doing it indoors. Rulez are, nothing inside, one plant outside is decriminalised, like a speeding fine.

OK. you got a good lawyer, but most free ones, and some fee based lawyers are shit. Trust your vibe, if you dont have faith in your representative, ditch 'em, and ask to represent yourself, or a retrial

I got lucky in my case, but really...it's not in the communities interest to make me a criminal, so justice was served, my herbs got confiscated, and I didn't get a conviction

I think in your case a lawyer wasnt necessary but you certainly did run the gauntlet, in your case you did well and at least you admitted to it and answered truthfully so judges can normally see that immediately. True legal aid does have crappy lawyers but to get a $10000 grant for $500 bucks is generally good maths. If its just a basic drink driving conviction for example a lawyers probably not worth it but other than that from what i have seen if the case is any more serious than that i would be using a lawyer every time without hesitation.
