reptyle Posted May 13, 2011 I'll show ya how to stop it... oh and a tid bit or a taste... i recently tried to have alcohol banned as a risk to public health and safety and was informed that currently existing state and federal legislation is deemed sufficient for "managing" such risks and that the appendix B entry would stand. (http://www.tga.gov.au/industry/scheduling-decisions-1103-final.htm) ethyl alcohol has been included in appendix B since 1967 when it was classified as a solvent used in insecticide products and not deemed unsafe for public availability. Substances with hallucinogenic natures were originally included in the schedule 9 equivalent for the reason that any hallucinogen is deemed to involve inherent risks of misuse. No information regarding actual toxicity or data reported in regards to patterns of use and possible risks have been submitted to the TGA regulatory bodies. Harmala alkaloids were included in the schedule 9 in 1985 as they were deemed to have no validated medicinal value and it was noted that they MAY be involved in caused negative side effects in sheep which consume Tribulus terrestris. This study could not verify that it was the small amounts of harmala alkaloids which caused the limb pareisis (tremors). In June 2010 an application to reschedule entheogenic substances was submitted to the TGA. This was considered by the committee and it was deemed that for reasons of public health and safety substances used in " religious spiritual or shamanic contexts" were appropriately scheduled. (http://www.tga.gov.au/archive/committees-ndpsc-record-59.htm) A member of the committee noted that the schedules were designed not to prohibit completely such substances but to limit their availability to those uses specified in the schedules definition. Namley, "medical and scientific research and for teaching and training purposes"... The schedule also specifies that exmeption for use in such activites may be granted by the federal or state heads of department of health. I have contacted the Minister for health and ageing regarding this access and was directed to contact the director general of my state health department. I was then informed by the state health dep. that it was not within their jurisdiction to grant such access to prohibited substances. I checked the NSW Drugs misuse and Trafficking Act 1985 and found Section 41 which says this: ------------------------------------------------------------ 41 Authorisation of Secretary of Department of Health An authorisation under this Act of the Secretary of the Department of Health: (a) shall be in writing, ( may be granted subject to such conditions as the Secretary thinks fit, and © may be revoked at any time by notice served on the person to whom it was granted or, if the Secretary thinks fit, by notice published in the Gazette. ----------------------------------------------------------------- So i wrote up an application for expemption from section 10, 11, 12 23 and 24. For use in researching spiritual religious and shamanic practices leading to eternal life and possible enlightenment. I used as examples the cultural practices outlined in buddhist islamic and Eulysian literature and indicated the proposed path leading towards the attainment of this sate. I was informed that for reasons of public health and safety the department did not feel such an exemption was appropriate. < it took three months to fish a response out of them and then it was backdated 3 days from the day i told them i wanted to organise a meeting. I then informed them that i would be contacting the Administrative appeals tribunal to have the decision reviewed and that they should conduct an internal review of their process in preparation for this. I am expecting the response to this review on 31st of May 2011. I was also informed that i could aproach the NSW supreme court for a ruling on the validity of this decision. I included in my application the relevance of currently available scheudle 8 (opiates, amphetamines and anti-psych) substances to severely metnally ill individuals with a known high risk of suicide and or violence. The application for rescheduling of ethyl alcohol and its hypocrisy given the rejection of other enthoegnic substances (substances used in religious spiritual or shamanic context), such as ethyl alcohol is used in catholic mass, were deemed unfit for public consumption... I contacted the Federal Ombudsman and they investigated the issue...i was informed that the ombudsman could not change the decision and could only ensure that "correct procedure" was adhered to. I cannot provide specific details for legal reasons however i believe i can say i have recently applied to include a new schedule within the SUSMP such that a more UNIFORM approach may be undertaken to schedule substances used in religoius practices. This will be decided on sometime after may. What i propose is that anyone who is interested start compiling a profile stating your purposes and proposed activites given the availability of these substances. A document called the entheogenic substance safety protocol was designed by the Order of the Gnostic Sacrament, this document outlines the correct procedure for safe regulated use of Psychoactive substances in an entheogenic context. and includes necessary data recording fields such that valid research may be integrated into the use of such products. I will get a copy of this document uploaded for your comment. So what you guys need to do is...either sit back and stay quiet so you dont ruin this work... or if you know something i dont, let me know. I will continue to update this information. reptyle Posted May 13, 2011 i should also mention that the Minister for Health and Ageing has authorisation under law to change any part of the SUSMP as per personal discretion. We must prove that we are valid Austrlian citizens with contructive activites and information to share with our people in the hope of advancing our culture and our selves. OM! Specialising in religious and spiritual research conducted in a scientificaly valid environment. We also teach and offer training programs for individuals and groups requiring case by case mind system designs. It is an Order. We also offer specialist consulting to various groups.
