7baz Posted June 10, 2012 i know the blacks law dictionary is valid for all common law countries , this includes Australia. but is any crook judge or magistrate going to laugh or take me seriously when i start throwing definitions at him or her in the court ? do lawyers and barristers not use the blacks law dictionary for there own definitions and legal terms ? occidentalis Posted June 10, 2012 Yes, it is commonly used - however most legislation carries its own definitions for specific terms within it, which would override any other definitions. Blacks is not the only source of legal definitions. So make sure you know what you're talking about before you try anything out in court.
7baz Posted June 10, 2012 i am referring to comon words , simple definitions and not legislation.as far as i am concern the 600 odd rules , statues and legislation are illegal as they conflict the commonwealth constitution , there has been no referendum to tamper with section 109 : When a law of a State is inconsistent with a law of the Commonwealth, the latter shall prevail, and the former shall, to the extent of the inconsistency, be invalid.
